1. Acceptance of Terms

Welcome to FarmToPlot.com (“FarmToPlot” or “the Platform”). These Terms and Conditions (“Terms”) govern your use of the FarmToPlot website, any related mobile applications, and services provided by FarmToPlot. By accessing or using our Platform, or by clicking “I agree” to these Terms, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Ads Transparency principles. If you do not agree with any part of these Terms, you must refrain from using the Platform.

These Terms constitute a legally binding agreement between you (also referred to as “User” or “you”) and FarmToPlot (operated by FarmToPlot Private Limited, an Indian company). FarmToPlot may be referred to as “we,” “us,” or “our.” The words “use” or “using” in these Terms refer to any time you, directly or indirectly, access or use the Platform or any of its services or content.

Electronic Record: This document is an electronic record in terms of applicable law (including the Information Technology Act, 2000 and its amendments). It is generated by a computer system and does not require any physical or digital signatures.

2. Eligibility

  • Legal Age: You must be at least 18 years old (or the age of majority in your jurisdiction) to use FarmToPlot’s services. By using the Platform, you represent and warrant that you are legally competent to form a binding contract under Indian law.

  • Minors: Individuals under 18 may use the Platform only with the involvement and consent of a parent or legal guardian, under such person’s registered account, and under their supervision. The supervising adult will be responsible for all activities of the minor on the Platform.

  • Account Registration: Certain features (such as posting reviews, scheduling visits, making inquiries, or accessing paid services) may require you to create an account. When registering, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account. If you suspect any unauthorized use of your account, you must notify FarmToPlot immediately. We are not liable for any loss or damage arising from your failure to secure your account.

  • User Obligations: Whether or not you create an account, you agree to comply with these Terms and all applicable laws. You may only use the Platform for lawful purposes related to seeking real estate information or services as intended by FarmToPlot.

3. Services Offered by FarmToPlot

FarmToPlot is a real estate aggregator and information platform that connects users with real estate opportunities and related services. We are not a real estate broker, agent, financial institution, or developer, and we do not conduct real estate transactions or charge any brokerage for property sales/rentals. Our services include:

  • Property Listings and Information: We display real estate listings (such as plots, apartments, houses, commercial properties, etc.) provided by third-party partners including real estate brokers, developers, agents, and sometimes directly by property owners. These listings include information like property descriptions, prices, layouts, availability, and other details. FarmToPlot may also provide informational content such as blog articles, market insights, or guides to assist users in making informed decisions.

  • Lead Generation & Inquiries: The Platform enables you to express interest in a property by submitting inquiry forms or contact requests. When you inquire about a property, we forward your contact information and message to the relevant seller, broker, agent, or developer (“Listing Partner”). This service is provided to help you connect with those offering the property.

  • Visit Booking Service: FarmToPlot allows you to request or book slots for property site visits for certain listings. Through this service, you can select a preferred date and time to visit a property, and we communicate that request to the property’s representative (such as the broker or developer). We act as a facilitator for scheduling purposes.

  • User Reviews and Testimonials: We may feature user-generated content including reviews, ratings, and testimonials related to properties, projects, real estate services, or user experiences. This allows users to share opinions and feedback on real estate projects or the Platform’s services.

  • Paid Services and Memberships: FarmToPlot might offer certain premium services or add-ons for a fee. For example, we may provide premium listing packages for sellers/agents, featured listing promotions, personalized assistance for property buyers, or other value-added services. Users may make payments on the Platform to purchase these services.

  • Advertisements and Partner Content: We display advertising content and sponsored listings from third parties (developers, brokers, advertisers) as part of our services. Some property listings or banner ads may be paid promotions clearly disclosed to users, in line with our Ads Transparency principles.

Important: FarmToPlot’s role is limited to providing a platform for information and initial connection. We do not buy, sell, or rent properties ourselves, and no brokerage or agency relationship is created between FarmToPlot and users by your use of the Platform. Any purchase, sale, rental, or lease agreement for a property is strictly between the users (e.g., buyer and seller, or tenant and landlord) and the relevant Listing Partner. FarmToPlot is not a party to any final agreement or transaction between users and real estate sellers/agents, and we do not perform any due diligence or verification of property title, legal status, or contractual terms on behalf of users.

4. Property Listings & Information Accuracy

We strive to ensure that the information on FarmToPlot is helpful, up-to-date, and accurate. However, FarmToPlot does not guarantee the accuracy, completeness, or reliability of any property listing or other content on the Platform. Please note the following:

  • Third-Party Content: Many details on our Platform are provided by third parties: property owners, developers, brokers, agents, or are sourced from public databases and third-party services. For example, FarmToPlot may display data and content from third-party sources such as Google Maps, Apple Maps, Google Reviews, and information provided directly by real estate brands or partners. These are provided for user convenience. We do not have control over such third-party content and cannot vouch for its accuracy.

  • No Warranty on Listings: Listings (including property specifications, images, videos, pricing, availability, location, amenities, dimensions, legal approvals, and other details) are uploaded by or obtained from Listing Partners and other external sources. FarmToPlot does not independently audit or verify each piece of data. There may be errors, omissions, outdated information, or inaccuracies. The inclusion of a property listing on our Platform does not mean we endorse the property or have verified the authenticity or quality of such listing.

  • Informational Purpose Only: All content and tools on FarmToPlot are provided for general informational purposes to assist you in your real estate decision-making. It should not be considered professional advice (legal, financial, or real estate advice) or a substitute for conducting your own research. You should always verify important details directly with the relevant seller, developer, or agent. This includes verifying property dimensions, legal ownership and title, regulatory approvals, price, and availability. We strongly recommend visiting the property in person and seeking independent professional advice (such as legal counsel or property inspection services) before making any real estate transaction decision.

  • Updates and Changes: Property availability and prices can change rapidly. A listing that appears as available on FarmToPlot may have been sold, booked, or changed by the owner by the time you act on it. We do not guarantee that any property you view on our Platform will remain available. Users are responsible for confirming the current status of properties with the Listing Partner.

  • Mapping and Location Data: Any maps, location pins, or commute distance information on FarmToPlot (for example, via Google Maps or Apple Maps integration) are for reference. They may not always pinpoint the exact property or could show approximate boundaries. FarmToPlot is not liable for any discrepancies in location data or map visuals.

  • No Liability for Errors: FarmToPlot, to the fullest extent permitted by law, disclaims any liability for errors or omissions in any content (text, images, data, graphs, etc.) on the Platform. If you notice any incorrect information, you can contact us to request a correction, but we make no guarantees to correct any particular error. Users agree that they will not rely solely on the information provided on the Platform for critical decisions. All reliance is at the user’s own risk.

5. Sponsored Listings and Advertising Transparency

FarmToPlot may display advertisements, sponsored content, or partner listings in various sections of the Platform. We believe in transparency when content is promotional or paid for, and we adhere to our Ads Transparency principles:

  • Sponsored Listings: Some property listings or projects featured on FarmToPlot might be paid promotions. For example, a developer or broker may pay to have their project featured or highlighted. Such listings will be identified with labels such as “Sponsored,” “Featured,” “Ad,” or similar indicators, to distinguish them from organic listings. We strive to make it clear which content is sponsored.

  • Promotional Content: In addition to property listings, you may see banner ads, native ads, or other promotional messages from third-party advertisers (including real estate brands or related service providers). These too will be labeled or segregated as advertisements.

  • No Endorsement: Even if a listing or ad is paid for, FarmToPlot does not endorse or guarantee the advertised property, project, or service. All descriptions and claims in sponsored content are provided by the advertiser. We do not make any warranty regarding the accuracy of promotional claims. Users should treat sponsored listings with the same level of due diligence and scrutiny as any other listing.

  • Disclosure of Partnerships: FarmToPlot may have partnership arrangements with certain brokers, agents, or developers to display their inventory or provide special services. Any preferential placement or display resulting from such partnerships will be done in a transparent manner (for instance, tagged as “Partner Listing” if applicable).

  • Ads and User Data: Please review our Privacy Policy to understand how we use cookies or personal data for advertising or sponsorship purposes. By using the Platform, you acknowledge that sponsored content and advertising are a part of our business model, and FarmToPlot may receive fees or commissions from advertisers or partners when you view, click, or interact with such content. However, such commercial arrangements will not affect our commitment to user transparency and fairness.

6. Inquiries and Lead Generation Service

FarmToPlot’s inquiry service allows users to request more information about a property or express interest in it. When you submit an inquiry or contact request through the Platform:

  • Consent to Contact: You authorize FarmToPlot to share the contact details and message you provide (such as your name, phone number, email, and any query) with the relevant Listing Partner (e.g., the property’s broker, agent, developer, or owner). You also consent to receive communications from that Listing Partner (via phone, SMS, email, etc.) in response to your inquiry.

  • No Guarantee of Response: FarmToPlot does not guarantee that any particular Listing Partner will respond to your inquiry, or how quickly they will do so. Once we pass on your lead, it is the responsibility of the broker/agent or seller to contact you. We are not liable if a Listing Partner fails to respond or if the information provided to you by the third party is not satisfactory.

  • Quality of Leads: We expect users to submit inquiries only for genuine interest in the property. You must not use the inquiry forms for unsolicited marketing, harassment, or any purpose other than seeking information about that property. We reserve the right to limit the number of inquiries or filter inquiries to prevent spam or abuse.

  • No Agency or Advice: In facilitating an inquiry, FarmToPlot is not acting as your agent or as an agent of the seller. We do not negotiate on your behalf, provide advice on specific transactions, or validate any of the responses or offers given by the Listing Partner. Any ensuing engagement (e.g., site visits, negotiations, transactions) between you and the seller/agent is outside the scope of our Platform and solely between the parties.

  • Privacy of Communications: Communications facilitated through our Platform may be monitored or stored by us in accordance with our Privacy Policy, to ensure quality of service, prevent fraud, or for record-keeping. By using the inquiry service, you agree to such monitoring. We will handle your personal data as per our Privacy Policy.

7. Property Visit Booking

We offer a feature for booking property visit slots, aimed at streamlining the scheduling of site visits for interested buyers/tenants. When using the visit booking service, please note:

  • Facilitation Role: FarmToPlot’s system allows you to request a visit by selecting a date/time and submitting a request. FarmToPlot forwards this request to the concerned Listing Partner (agent/developer/owner) for confirmation. We do not own the properties and are not the ones conducting the site visits; we only coordinate the request.

  • Confirmation is Required: A requested booking slot is not a guaranteed appointment. The actual appointment is confirmed only when the Listing Partner acknowledges and agrees to the schedule. You should receive a confirmation (through the Platform, email, or call) if the visit is confirmed. We recommend you reconfirm with the property contact as the date approaches.

  • Subject to Change or Cancellation: The property visit may be rescheduled or canceled by the Listing Partner due to availability, unforeseen circumstances, or other issues (for example, property already sold, representative unavailable, etc.). FarmToPlot is not responsible for any such changes. We will try to notify you if we receive any update about changes in the visit schedule, but we are not liable for any costs, damages, or inconvenience you may incur due to a canceled or changed appointment.

  • No Outcome Guarantee: Arranging a site visit through FarmToPlot does not guarantee any particular outcome, such as securing the property or getting any special deal. We do not assure that the property will meet your expectations or that the seller will hold the property for you. All decisions and outcomes depend on your subsequent negotiations and agreements with the seller/agent.

  • User Responsibilities During Visits: You agree to conduct yourself professionally and safely during any site visit arranged through FarmToPlot. FarmToPlot is not responsible for any incidents, disputes, or injuries that may occur during the visit, as the visit is directly between you and the property representative. It is also your responsibility to arrange your own transportation to the property and exercise due caution when visiting any location.

  • Fees: Currently, FarmToPlot does not charge buyers/visitors a fee for booking a site visit. If any future service fee is introduced for coordinating visits, it will be communicated and only levied with your consent.

8. Payments, Fees, and Refund Policy

Use of FarmToPlot’s basic services (searching listings, making inquiries, booking visits, reading content, etc.) is generally free for buyers or prospective tenants. However, FarmToPlot may charge fees for certain premium services or offerings. This section explains the terms related to any payments:

  • Paid Services: If you choose to use a paid service (for example, a paid advertising package, premium listing upgrade, featured placement, or any buyer assistance service that requires payment), you will be informed of the fees, charges, and applicable taxes (if any) before you commit to purchase. All fees are quoted in Indian Rupees (INR) unless specified otherwise, and payments must be made in the currency stated.

  • Payment Process: Payments on FarmToPlot will typically be processed via trusted third-party payment gateways or processors. You must provide current, complete, and accurate billing information. By making a payment, you authorize us or our payment processor to charge the specified amount to your provided payment method (such as credit card, debit card, UPI, net banking, etc.). We do not store your payment credentials on our servers; all transactions are handled through secure encryption by the payment provider.

  • Non-Refundability: All payments made to FarmToPlot for services are non-refundable, except as expressly stated in these Terms or in service-specific terms at the time of purchase. This means that once you have paid for a service or package, you will not be entitled to a refund of fees if you change your mind, decide not to utilize the service, or are dissatisfied with the service, unless a refund is required under Indian law or explicitly promised by us for a particular service. For example, if technical errors on our Platform (for which we are responsible) resulted in you being charged twice or not receiving the service paid for, we may, upon verification, refund or provide the service as intended at our discretion.

  • Service-Specific Refund Terms: In rare cases, a particular service might come with its own refund or cancellation policy (for instance, a money-back guarantee for a specific offering, or a pro-rated refund for long-term subscriptions if canceled early). Any such terms will be communicated to you in the service description or at the time of payment, and those terms will apply in that scenario (superseding the general non-refund rule to the extent of any conflict).

  • Receipts and Taxes: Upon successful payment, FarmToPlot will endeavor to provide you with a confirmation and receipt (usually via email or via your account dashboard). Our fees exclude all applicable taxes, duties, or government levies unless stated. You are responsible for any taxes (such as GST) that may be applicable to your purchase, and such taxes may be added to the charged amount if required by law.

  • Late Payments and Default: If you owe any fees to FarmToPlot (for example, for a subscription service for sellers/agents) and your payment method fails or your account is past due, we reserve the right to suspend or limit your service until full payment is made. We may also charge applicable late fees or interest as allowed by law for overdue amounts.

  • Chargebacks and Disputes: If you initiate a chargeback or payment dispute with your bank for a transaction made on FarmToPlot, we reserve the right to suspend the related services and any associated account until the dispute is resolved. We encourage users to first contact us in case of any billing issues, so we can try to resolve it directly. Fraudulent payment disputes may lead to account termination.

  • Pricing Changes: FarmToPlot reserves the right to change the fees of any service, or introduce new fees, at our discretion. Such changes will be communicated (for instance, on the pricing page or during checkout) and will not apply retroactively to services you have already paid for, except in the case of subscription renewals where you will be informed in advance.

9. User-Generated Content (Reviews, Comments, and Testimonials)

FarmToPlot may allow users to post content in certain areas of the Platform, such as property reviews, testimonials, ratings, comments, feedback, or forum posts. By submitting any content to our Platform, you agree to the following:

  • Responsible Content: You are solely responsible for any content you post or provide. You agree that your submissions will be truthful, fair, and accurate to the best of your knowledge. If you write a review or testimonial, it should be based on your actual experience or honest opinion.

  • Prohibited Content: You must not post any content that: (a) is false or misleading; (b) is defamatory, libelous, abusive, harassing, or threatening; (c) is obscene, pornographic, vulgar, or offensive; (d) promotes discrimination, bigotry, racism, hatred, or harm against any individual or group; (e) invades another’s privacy or includes sensitive personal information of someone else without permission; (f) infringes any third party’s intellectual property or other rights (e.g., you may not post photos or text copied from another source without authorization); (g) violates any law or regulation; or (h) contains viruses, malware, or any code that could harm the Platform or users’ devices.

  • No Commercial Spam: User content must not be used for commercial advertising or promotional purposes (unless explicitly allowed in a section of the Platform, such as an agent’s profile description). You agree not to post unsolicited promotions, contests, or spam. Do not include contact information or external links in reviews unless relevant and allowed, as we may remove content that appears to be self-promotional or unrelated to real estate.

  • License to FarmToPlot: By posting content on FarmToPlot, you grant FarmToPlot a worldwide, royalty-free, sublicensable, non-exclusive license to use, reproduce, publish, translate, distribute, modify, display, and create derivative works of your content in connection with operating and promoting the Platform. For example, we may display your review on a property page, use excerpts in our marketing materials or social media (with attribution to you by name or username), or share your testimonials with the concerned real estate partner. You retain ownership of your content; this license does not transfer ownership to us, but it does allow us to legally provide and promote the content you contribute.

  • Moderation and Removal: FarmToPlot reserves the right (but is not obligated) to monitor, review, and moderate user-generated content. We may remove or edit any user content at our sole discretion for any reason, especially if it violates these Terms or our content guidelines, or for any reason including if it’s flagged by other users or authorities. We are not responsible for any failure or delay in removing such material. The presence of specific content on our Platform does not signify our endorsement of the views expressed in it.

  • No Endorsement by FarmToPlot: Any opinions, advice, statements, or other information expressed or made available by other users through reviews or comments are those of the respective author(s) and not of FarmToPlot. We do not endorse and are not responsible for the accuracy or reliability of any user-generated content. Users should understand that such content is based on individual perspectives which may not be verified.

  • Reporting Issues: If you believe any user content on the Platform violates these Terms or your rights (e.g., is defamatory or infringing), please notify us through the Grievance Officer or contact email provided in these Terms. We will investigate such complaints and take appropriate action as necessary under law (including removing or disabling access to the contested content if warranted).

  • User Content is Public: Please note that any content you post may be visible to all users of the Platform (and possibly to others on the internet, if publicly accessible). Do not share information in your posts that you are not comfortable making public. FarmToPlot is not liable for how other users may use or interpret your publicly posted content.

By contributing content, you also represent and warrant that you have all necessary rights and permissions to post that content and to grant the license above to FarmToPlot. If your content includes the likeness, name, or personal information of any other person, you must have that person’s consent to share it.

10. User Obligations and Acceptable Use

When using FarmToPlot, you agree to conduct yourself in a lawful and respectful manner. You are prohibited from misusing the Platform or engaging in any activity that harms others or the integrity of the Platform. Without limiting the generality of the foregoing, you agree NOT to:

  • Provide False Information: You will not post, list, or share any information on the Platform that is false, fraudulent, misleading, or inaccurate. This includes not posting fake property listings, incorrect property details, or false reviews. You must not impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

  • Violate Laws or Rights: You will not use the Platform for any purpose that is illegal or prohibited by law. You agree not to upload or share any content that infringes any third party’s intellectual property rights, privacy rights, or other rights. You also agree not to use the Platform to harass, defame, stalk, threaten, or violate the legal rights (such as rights of privacy and publicity) of others.

  • Interfere with Platform Operations: You will not engage in any activity that could disrupt, damage, overburden, or impair the functioning of FarmToPlot or interfere with any other party’s use of the Platform. This includes not introducing viruses, worms, malware, Trojan horses, or any other harmful code. You must not attempt to gain unauthorized access to our systems or networks, or any user accounts, or bypass any measures we use to secure the Platform.

  • Scraping and Data Use: You agree not to use any automated means (such as bots, crawlers, spiders, or scrapers) to access the Platform or collect data without our express permission. You will not harvest or collect information about users or property listings for any unauthorized purpose, including for commercial solicitation or competitive advantage. The content and data on FarmToPlot are for your personal use in connection with seeking real estate; commercial use of listing data or other content without our prior written consent is strictly prohibited.

  • Frame or Copy the Platform: You will not frame, mirror, or otherwise reproduce or copy the Platform or any content within it without permission. You must not attempt to reverse engineer any component of our website or app, or use our software for any purpose other than the intended use.

  • Post Unauthorized Commercial Content: Other than as expressly permitted (for example, authorized agents and developers posting property listings or advertising via our services), you will not use the Platform to advertise products or services or to solicit anyone to buy or sell any products or services unrelated to the intended use of FarmToPlot. Unsolicited or irrelevant commercial messages or links posted on the Platform are prohibited.

  • Security: You will not share your account password or allow anyone else to access your account or do anything that might jeopardize the security of your account. You are responsible for all actions taken under your account credentials.

  • Abuse of Communication Tools: If the Platform provides communication facilities (like chat with an agent, or commenting), you must use these only for their intended purpose. You will not use these tools to send spam, unsolicited messages, chain letters, pyramid schemes, or any form of duplicative or unsolicited messages.

  • Compliance: You will comply with all additional policies or guidelines of FarmToPlot that are posted (such as our Privacy Policy, any community guidelines, and any instructions provided to you within the Platform). These policies are considered part of these Terms.

  • Cooperation with Investigations: You agree to cooperate with FarmToPlot in any investigation by FarmToPlot or governmental authorities regarding conduct on or through the Platform. This can include providing truthful information about your involvement or knowledge of certain activities if requested.

Consequences of Violations: If you engage in any of the prohibited uses or otherwise violate these Terms, FarmToPlot reserves the right to take appropriate action. This may include removing or modifying content you have posted, suspending or terminating your account or access to the Platform, and, in the case of suspected unlawful activities, reporting you to the law enforcement authorities. You understand that any attempt to deliberately damage the Platform or undermine its legitimate operation may also be a violation of civil and criminal laws.

11. Intellectual Property Rights

11.1 FarmToPlot’s Intellectual Property

All content, features, and functionality on the Platform (except for content provided by users or third parties) are the exclusive property of FarmToPlot or its licensors and are protected by applicable intellectual property laws. This includes, but is not limited to, the website and app design, layout, and look-and-feel; text, graphics, images, video, and audio content we create or provide; logos and trademarks (such as the “FarmToPlot” name and logo); software code and algorithms; and compilations of data (such as the organization and arrangement of property listings, databases, and indexes).

  • Trademarks: “FarmToPlot,” the FarmToPlot logo, and any other product or service names or slogans displayed on the Platform are trademarks or service marks of FarmToPlot (whether registered or unregistered) and may not be used by you without our prior written permission. All other marks that appear on the Platform are the property of their respective owners (for example, trademarks of real estate developers or other companies), and are used on the Platform for identification purposes only. Use of any such trademarks or content without permission may violate the rights of the respective owner. Nothing in these Terms or on the Platform should be construed as granting any license or right to use any trademark displayed on the Platform without our written permission or that of the third-party rights holder.

  • Copyright: The collective and individual content on FarmToPlot (other than content provided by users) is protected by copyright. We either own the copyright or have obtained rights to use the materials (like certain images, data, or third-party content). You must not copy, reproduce, distribute, publicly display, or create derivative works of our content without explicit authorization. For instance, you cannot scrape our listings or photographs to repost elsewhere, nor use our text descriptions in your own site, without permission.

  • License for Personal Use: FarmToPlot grants you a limited, revocable, non-transferable, and non-exclusive right to access and use the Platform and its content for your personal, non-commercial use, i.e., for the purpose of searching for real estate information or using our services as intended. This license does not allow you to resell or commercially use our Platform or content, collect or use listings or descriptions for the benefit of another business, make bulk copies of any content, or use data mining/robots (as noted in User Obligations). We reserve all rights not expressly granted to you.

11.2 User & Third-Party Content Rights

  • Your Content: As noted in the User-Generated Content section, you retain ownership of any original content you submit to FarmToPlot (such as reviews, comments, photos you upload, etc.). However, by submitting content, you grant FarmToPlot the rights to use it as described in these Terms. You also agree that we have the right to remove or disable access to any of your content at our discretion.

  • Third-Party Content: The Platform may include third-party content (e.g., map data from Google or Apple, user reviews from Google if we aggregate them, or content licensed from data providers). Third-party content is the intellectual property of its respective owners. For example, mapping imagery and place information may be subject to Google Maps/Google Earth Additional Terms of Service and Google’s privacy policy, or Apple Maps terms, as applicable. You must not remove any copyright or proprietary notices from any content on the Platform. Use of third-party content may be subject to additional terms imposed by those parties; by using the Platform, you also agree to comply with such third-party terms when they are applicable (for instance, not downloading or reusing Google Maps images outside the Platform context).

  • Feedback: If you provide FarmToPlot with any suggestions, ideas, enhancement requests, or other feedback regarding the Platform (“Feedback”), you acknowledge that such Feedback is given voluntarily. You hereby grant FarmToPlot a perpetual, worldwide, irrevocable, sublicensable, transferable license to use, modify, incorporate, or otherwise exploit the Feedback for any purpose, without any obligation of compensation to you. This helps us improve our services.

  • Intellectual Property Infringement: We respect intellectual property rights and expect users to do the same. We have procedures in place to investigate and address such complaints under applicable laws (including the Information Technology Act and rules for content removal). We may remove or disable content alleged to be infringing and terminate accounts of repeat infringers when appropriate.

12. Disclaimer of Warranties

Use at Your Own Risk: FarmToPlot provides the Platform, its services, and all content on an “as is” and “as available” basis, without any warranties of any kind, whether express, implied, or statutory. Your use of the Platform and services is at your sole risk.

To the fullest extent permitted under applicable law, FarmToPlot (including our directors, employees, partners, and agents) disclaims and excludes all warranties, express or implied, related to the Platform and your use thereof, including but not limited to:

  • Implied Warranties: Any and all implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy of data, or system integration are expressly disclaimed. We do not warrant that the information provided is accurate, reliable, or correct; that the Platform will meet your expectations or requirements; or that any legal, financial, or real estate advice has been provided (because it has not).

  • No Guarantee of Results: We make no guarantee that using FarmToPlot will result in you finding a satisfactory property, closing a successful real estate transaction, or obtaining any particular outcome. Real estate deals involve many factors outside our control. FarmToPlot is not responsible for any failure by a buyer or seller to follow through with a transaction, nor for any losses if a property you are interested in is no longer available.

  • Platform Availability: FarmToPlot does not warrant that the Platform will be uninterrupted, timely, secure, or error-free. While we strive for high availability, we do not guarantee that the Platform will be available at all times or that it will be free from defects, viruses, or other harmful components. Periodic downtime for maintenance or technical issues may occur. We will make reasonable efforts to keep the service operational, but all downtime and technical glitches are provided for under this “as available” disclaimer.

  • Quality of Information and Third-Party Services: We do not warrant or make any representations regarding the quality, accuracy, or reliability of any content, materials, services, or information provided by or obtained from third parties through the Platform. This includes listings provided by partners, third-party reviews, maps, or any external links. Any reliance on or use of any third-party content is at your own risk. FarmToPlot is not responsible for any third-party services that may be integrated with or linked from our Platform (for instance, a link to a home loan provider or a moving service); use of those services will be governed by their own terms and we make no warranties on their behalf.

  • Security: While we implement reasonable security measures, FarmToPlot does not warrant that the Platform will be free from unauthorized access, or that your use of the Platform will be completely secure. Internet-based services inherently carry some risk, and we cannot guarantee absolute security. You are responsible for using up-to-date antivirus software and safeguarding your credentials.

  • No Employee/Agent Warranties: No advice or information (oral or written) obtained by you from FarmToPlot or through any communications or advertisements shall create any warranty not expressly stated in these Terms. FarmToPlot employees and agents are not authorized to make modifications to these warranties or additional warranties, so you should not rely on any such statements.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain rights. If such laws apply to you, some of the above disclaimers may not apply to the extent disallowed. In such cases, any implied warranties will be limited to the minimum duration permitted by applicable law.

13. Limitation of Liability

Under no circumstances shall FarmToPlot, its owners, directors, officers, employees, affiliates, or agents be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of (or inability to use) the Platform or its services, whether or not the damages were foreseeable and even if FarmToPlot was advised of the possibility of such damages. This includes, without limitation:

  • Loss of Profits or Opportunities: Any loss of anticipated sales, revenue, real estate opportunities, business, data, or profits, whether incurred directly or indirectly. For example, if you relied on information on our Platform and incurred financial loss, or missed out on a property deal, FarmToPlot will not be liable for those damages.

  • Personal Injury or Property Damage: Any injury or damage (whether to person or property) that may occur during site visits or through interactions initiated via FarmToPlot. FarmToPlot is not responsible for accidents, disputes, or damages that occur at properties listed on our Platform or through engagements with third-party service providers.

  • Reliance Damages: Any loss or damage arising from your reliance on any information or content obtained through the Platform (such as decisions made based on property listings, reviews, or other content). You assume full responsibility for the use of information from our Platform.

  • Unauthorized Access: Liability for any unauthorized access to or use of our servers and/or any personal information stored therein, unless directly caused by our gross negligence or willful misconduct. Similarly, we are not liable for any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our services by any third party.

  • User Content or Conduct: Any defamatory, offensive, or illegal conduct of any third party (including other users or Listing Partners) through the Platform. FarmToPlot is an intermediary platform; we are not liable for what others say or do, even if accessible via our service.

Cap on Liability: To the maximum extent permitted by law, in no event shall FarmToPlot’s total cumulative liability for any claims arising out of or related to these Terms or the use of the Platform exceed the amount (if any) that you paid to FarmToPlot in service fees in the 6 months prior to the event giving rise to the liability or INR 5,000 (Indian Rupees Five Thousand), whichever is lower. If you have not made any paid transactions with FarmToPlot, FarmToPlot’s total liability shall be zero for any claims.

Basis of the Bargain: You acknowledge that FarmToPlot has offered its services and entered into these Terms in reliance on the warranty disclaimers and limitations of liability set forth herein, which reflect an agreed allocation of risk between you and us. These disclaimers and limitations form an essential basis of the bargain between you and FarmToPlot.

Exceptions: Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages (for example, in India, liability for personal injury caused by negligence may not be disclaimed). In such jurisdictions, our liability will be limited to the fullest extent permitted by law. Nothing in these Terms is intended to exclude or restrict liability that cannot be lawfully excluded, such as liability for death or personal injury directly and solely caused by our gross negligence or willful misconduct.

14. Indemnification

You agree to indemnify, defend, and hold harmless FarmToPlot, its parent company, affiliates, and their respective officers, directors, employees, and agents (collectively, the “FarmToPlot Parties”) from and against any and all losses, liabilities, claims, demands, damages, costs, or expenses (including reasonable attorneys’ fees and legal costs) arising out of or related to:

  • Your Use of the Platform: Any use or misuse of the Platform or services by you, including any content you submit, post, or transmit through our Platform. If your use of FarmToPlot causes damage to or infringes the rights of a third party, you will bear the responsibility.

  • Violation of Terms: Your breach or alleged breach of these Terms, Privacy Policy, or any other policies that are incorporated by reference. For example, if you violate the User Obligations (such as by posting illegal content or scraping data) and that causes a claim against us, you agree to indemnify us.

  • Violation of Laws or Rights: Your violation of any law, regulation, or third-party right. This includes any real estate regulations or consumer protection laws applicable to your interactions (for example, if you as a seller post a property without having rights to it, or as a user you misuse personal data of another in violation of privacy laws).

  • Transactions and Disputes with Third Parties: Any dispute or litigation between you and a third party (e.g., a broker, developer, another user, or an external service provider) arising from any transaction or attempt to transact that was initiated on or through the Platform. For instance, if you as a buyer have a dispute with a property seller regarding a sale, or you as a tenant have an issue with a landlord you met through FarmToPlot, you will handle it independently of FarmToPlot and indemnify us from any related claims.

FarmToPlot reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such case, you agree to cooperate with our defense of such claim and not to settle any such matter without the prior written consent of FarmToPlot. You remain responsible for any claim to the extent that indemnification was not accepted in a settlement that you made without our consent.

This indemnification obligation will survive any termination of your account or of these Terms.

15. Termination of Use

These Terms are effective unless and until terminated by either you or FarmToPlot. Both you and FarmToPlot have the right to terminate this agreement at any time, as follows:

  • By You: You may stop using the Platform at any time. If you wish to terminate your account (if you have one), you may do so by following the account deletion process in your profile settings (if available) or by contacting us via the support channels. Termination of your account will mean you can no longer log in or use features reserved for registered users. However, even after you deactivate or delete an account, some of your content (for example, reviews or inquiries you submitted) may persist on the Platform if it was shared with others, and certain data may be retained in backups or as required by law.

  • By FarmToPlot: We reserve the right to suspend or terminate your access to the Platform, or any portion of it, at our sole discretion, at any time and with or without notice. We may do this for any reason, including but not limited to: (a) your actual or suspected violation of these Terms or any applicable law; (b) prolonged periods of inactivity of your account; (c) your use of the Platform in a manner that may cause us liability or disrupt others’ use; (d) technical or security issues. In certain cases involving egregious violations or unlawful conduct, we may terminate access immediately. In other cases, we might send you a warning or request you to remedy a violation before termination.

  • Effect of Termination: Upon termination by either party, your right to use the Platform will immediately cease. You must cease all use of the Platform and destroy any copies of materials from the Platform in your possession (except for your own data or content that you have legitimate rights to). Any licenses granted to you will end. We will have no liability to you or any third party for account termination or loss of access to our services.

  • Outstanding Obligations: Termination will not affect any rights or liabilities that may have accrued prior to termination. Any fees owed to FarmToPlot before termination still must be paid, and no refunds will be given except as expressly provided in these Terms. If you had engaged in any unlawful activity or caused damage or loss, you remain responsible even after termination to address those issues (including potential legal liabilities).

  • Survival: Certain provisions of these Terms by their nature should survive termination. These include, without limitation, ownership provisions (Intellectual Property), warranty disclaimers, limitation of liability, indemnity, governing law and dispute resolution, and any licenses granted to FarmToPlot (e.g., for content usage) that are irrevocable or meant to survive (such as perpetual licenses to Feedback or user content already used). All such terms shall remain in effect after termination.

16. Governing Law and Dispute Resolution

These Terms and any dispute arising from your use of the Platform or our services shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

  • Jurisdiction: You agree that, subject to the arbitration clause below (if applicable), the courts located in Bengaluru, Karnataka, India shall have exclusive jurisdiction to adjudicate any dispute arising out of or relating to these Terms or your use of the Platform. You hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. (If you are using the Platform in any jurisdiction outside India, you agree that you will still be subject to the jurisdiction of the courts in Bengaluru, and the governing law will remain as Indian law.)

  • Arbitration (if applicable): At FarmToPlot’s sole discretion, we may require you to submit any dispute (including any claim we may have against you) to binding arbitration under the Arbitration and Conciliation Act, 1996, as amended. If arbitration is elected by FarmToPlot, it shall be conducted by a sole arbitrator appointed by us. The language of arbitration shall be English, and the venue shall be Bengaluru, India. The arbitrator’s award shall be final and binding on the parties, and judgment on the award may be entered in any court of competent jurisdiction. Each party shall bear its own costs of arbitration, and share the arbitrator’s fees equally, unless the arbitrator decides otherwise in the interest of justice. Important: This arbitration clause does not apply to a User who qualifies as a “consumer” under Indian consumer protection laws and who chooses to seek remedy under consumer dispute redressal forums; such users have the option to pursue claims in those statutory forums notwithstanding this agreement to arbitrate.

  • Injunctive Relief: Notwithstanding the above, FarmToPlot may seek injunctive or other equitable relief in any court of competent jurisdiction (and you agree to the jurisdiction of courts in Bengaluru, Karnataka) to prevent any actual or threatened infringement of our intellectual property or other proprietary rights.

  • Limitation on Time to File Claims: To the extent permitted by law, any claim or cause of action you have arising out of or related to use of the Platform or these Terms must be filed within one (1) year after such claim or cause of action arose. If you do not file within this time, then your claim is permanently barred. (This clause does not apply where prohibited by law, and does not limit any statutory rights under laws that mandate longer periods — e.g., certain consumer protection laws.)

  • No Class Actions: To the extent allowed by applicable law, you and FarmToPlot each agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

17. Privacy and Data Use

Your privacy is important to us. Our Privacy Policy describes how we collect, use, store, and protect your personal information when you use FarmToPlot. By using the Platform, you agree to the terms of the Privacy Policy and consent to the collection and use of information as described therein.

  • Ads and Cookies: We utilize cookies and similar technologies to enhance user experience and to serve relevant advertisements.   • User Communications: Any communication through the Platform (such as messages to an agent or feedback sent to customer service) may be monitored and recorded in line with our Privacy Policy. We do this to prevent fraud, ensure quality service, and comply with legal obligations.

  • Data Security: We implement reasonable security measures to safeguard your data. However, no online platform is 100% secure, and we cannot guarantee absolute security. You also have a role in protecting your data by keeping your login credentials confidential.

It is your responsibility to review these Terms periodically for any changes. Your continued use of the Platform following the posting of changes constitutes acceptance of those changes. If you do not agree to the updated Terms, you should stop using the Platform and, if applicable, terminate your account.

  • Changes to Services: We are constantly evolving and improving our services. We may add, alter, or remove functionalities or features of the Platform at any time. We may also suspend or discontinue certain services or features temporarily or permanently. We will try to provide notice if such changes significantly affect your usage, but this may not always be practicable. You agree that FarmToPlot shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform or any service or feature.

  • Temporary Interruptions: From time to time, the Platform may undergo maintenance or experience technical issues that interrupt service. While we endeavor to minimize downtime, we cannot guarantee the Platform will always be accessible. We appreciate your understanding during maintenance outages or technical troubleshooting.

19. Miscellaneous

  • No Agency or Partnership: You agree that no joint venture, partnership, employment, or agency relationship exists between you and FarmToPlot as a result of your use of the Platform or these Terms. FarmToPlot is an independent service provider, and you are using the Platform as an end-user. We do not have any fiduciary or contractual relationship with you beyond the terms explicitly stated here.

  • Entire Agreement: These Terms (along with the Privacy Policy and any other policies or guidelines incorporated by reference) constitute the entire agreement between you and FarmToPlot regarding your use of the Platform, and supersede any prior agreements, understandings, or arrangements (whether oral or written) relating to the subject matter herein. Any additional or different terms proposed by you (for example, in correspondence) are expressly rejected and will not bind us unless we agree in a written document signed by an authorized representative of FarmToPlot.

  • Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable by a competent court or tribunal, that provision shall be deemed severable from the Terms and shall not affect the validity and enforceability of the remaining provisions. The unlawful or unenforceable provision will be interpreted to fulfill its intended purpose to the greatest extent permitted by law, and the remaining provisions will continue in full force and effect.

  • Waiver: No failure or delay by FarmToPlot in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right or provision. Any waiver must be in writing and signed by FarmToPlot to be effective. If we do waive a default or breach by you, it will not be considered a waiver of any later default or breach.

  • Assignment: You may not assign or transfer these Terms (or any of your rights or obligations hereunder) without our prior written consent. We may freely assign, transfer, or delegate our rights and obligations under these Terms, in whole or in part, to any third party (for example, in the event of a merger, acquisition, or transfer of assets, or by operation of law) without notice to you. These Terms will bind and inure to the benefit of the parties and their permitted successors and assigns.

  • Notices: FarmToPlot may provide notices to you via email (to the address associated with your account, if you have provided one), through notifications on the Platform, or through any other reasonable means. You are responsible for ensuring we have your current email address. Notices to FarmToPlot should be sent to the contact email or address provided in the Contact section below. Email notices to us are deemed received when our email server logs that email as received, provided it is sent to the correct address. Physical mail notices are deemed received when actually delivered to our address.

  • Force Majeure: FarmToPlot shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor, or materials, failure of public utilities or telecommunications networks, or other causes beyond our control. We will use reasonable efforts to mitigate the effect of a force majeure event, but if such event continues for more than 30 days, either party may cancel any services affected by the event and receive a prorated refund (if applicable) for services not rendered.
